[Speed] Am i being too picky about my speeds?

So, i am curious what users here might think. Earlier this week, i majorly changed my plan, and wound up on a Blast Plus plan. I love the idea of 50/10, and should have the hardware to take it (6121). Initially, I was seeing speed test results of 35-40mbs; with ShaperProbe reporting me getting shaped to 25mbs; i called comcast, and sure enough, the modem was not provisioned correctly. Further tests now show this: DiffProbe release. January 2012. Build 1008. Shaper Detection Module. Connected to server 74.63.50.21. Estimating capacity: Upstream: 11864 Kbps. Downstream: 43230 Kbps. The measurement will take upto 2.5 minutes. Please wait. Checking for traffic shapers: Upstream: No shaper detected. Median received rate: 11685 Kbps. Downstream: No shaper detected.
